The sub-section 2 of Section 561 of the Ordinance, you sent out vide your letter No. 1711 of 15th October 1908, on reference No. 3571/05 and brought it into uniformity with the corresponding provision in the Straits Settlement.
See despatch No. 33991/08 and the annotated copy of the rules thereto annexed.
On 15th October 1908, the official referred to in your letter No. 357/65 was informed of the order as amended. I assumed that Section 2 of the Ordinance was modified to bring it into uniformity with the Straits Order 19 of 1904.
The two sections therefore have the same meaning and intent. I do not know whether Mr. Young has been consulted with the Straits Order and if so, whether he has recorded his views with regard to it; and, if not, whether he should have recorded it with regard to the other.
The staff cannot of course "decide" the meaning of the question raised by the Judge, but if he does decide that it should be amended so as to make it clear.
I submit that the said Section of the Ordinance should be amended in a similar fashion.
M. Collins, 27/9, directs that the Ordinance be amended, observing that the words in question were doubtless inserted through some misunderstanding, and informs Young, asking him to approve of his taking action on the assumption that the Ordinance will be amended.
